Please note that your purchases on this Website may have additional conditional terms related to that purchase. By accessing this website, you (the “User”) are agreeing to be bound by these website terms and conditions (“Terms”) of use, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

This website (the “Website”) belongs to Cornerstone Academic Services and its affiliates and partners. Access to and use of the Website is subject to these terms and conditions (“Terms”) and all applicable laws. Cornerstone Academic Services may revise these Terms at its will by updating this webpage. Your use of our Website following any such change represents your agreement to follow and be bound by the Terms as amended. If any change is unacceptable to you, please immediately terminate your use of the Website. Cornerstone Academic Services may also change, move portions of, delete portions of, or add to the Website from time to time under its sole discretion.

Communications with Cornerstone Academic Services

Unless the specific area of the Website is secure, as so indicated, any information of communiqué, including but not limited to, comments, suggestions, ideas, questions, or other sent to Cornerstone Academic Services via the Website or Internet electronic mail (e-mail), is the exclusive property of Cornerstone Academic Services and should not be deemed confidential. Cornerstone Academic Services cannot guarantee the confidentiality of transmissions over the Internet (unless otherwise expressed or indicated), including any receipt of personal information by us from you, the User. Cornerstone Academic Services is entitled to use any information or communication submitted to us for any purpose without restriction (including but not limited to reproduction, publication, disclosure, broadcast, posting, and compilation of such information or communication, or developing products and services incorporating the same) or compensation to the person sending the submission. Any submitted items by the User agree to these aforementioned terms. Furthermore, the person sending the submission, by virtue of submitting to Cornerstone Academic Services, acknowledges that the content is original and claims responsibility for its accuracy, appropriateness, and legality (including, without limitation, compliance with any federal or state intellectual property statues, regulations, and common law rules).

Cornerstone Academic Services strives to respect the privacy of individuals who visit the Website. Our Privacy Policy, which you may view here (the “Privacy Policy”), is incorporated herein by mention. By accepting our Terms and Conditions of Use, you further expressly consent to the use and disclosure of your personally identifiable and other information as described in the Privacy Policy.

By agreeing to use our services, you assure that any item submitted to Cornerstone Academic Services by you to the Website will be void of content that is harassing, libelous, defamatory, abusive, threatening, harmful, vulgar, profane, sexually-oriented, racially offensive, inaccurate, or objectionable by any means; violates any law, rule, or regulation; or infringes on copyrights, trademarks, or other intellectual property right, of any other organization, company, entity, or person; encourages conduct that could be considered a criminal offense, give way for civil liability, or violate any laws or regulations, domestic or international; or encourages the use of controlled substances. Cornerstone Academic Services reserves and will enforce the right to decline service if content has any of the aforementioned violations.

You agree not to impersonate any other person or entity, whether actual or fictitious, including impersonating an employee or consultant of Cornerstone Academic Services. You further agree not to use an inappropriate user name of any kind.

You acknowledge and agree that you may not upload, post, reproduce, or distribute any content on or through the Website that is protected by copyright or other proprietary right of a third party, without obtaining permission of the owner. Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject you to personal liability or criminal prosecution.

If you believe that your copyrighted work or the copyrighted works of others have been infringed, please send a written notification via electronic submission to admin@cornerstoneacademic.com, with “ATTN: Copyright Issue” in the subject line of claimed infringement to Cornerstone Academic Services copyright agent with the following information: an electronic or physical signature of the person authorized to act on behalf of the copyright owner; a description of the copyrighted work that you claim has been infringed; a description of where the allegedly infringing material is located on the Website; your telephone number, address and e-mail address; a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; and, a statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Upon receipt by Cornerstone Academic Services of notice of claimed copyright infringement containing the information specified above, Cornerstone Academic Services will promptly remove the allegedly infringing material from the Website. Cornerstone Academic Services shall have no liability to any user of the Website for the removal of any such material.

The materials on Cornerstone Academic Services’ web site are provided “as is”. Cornerstone Academic Services makes no warranties, expressed or implied, and hereby disclaims and denunciates all other warranties, including without limitation, implied warranties or conditions of suitability for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Cornerstone Academic Services does not warrant or make any representations concerning the accuracy, results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site.

Cornerstone Academic Services strives to provide a reliable platform to obtain academic services for its clients. However, Cornerstone Academic Services does not make an assurance that the contents of this site are whole, free of defect, or secure. Additionally, it makes no assurance that the service will be uninterrupted or error-free, or that there are no viruses or other harmful code. It is your responsibility, as the user, to take all precautionary measures to ensure that the information you use from this site is free of harm that could have a destructive effect on your hardware and/or software. From time to time, Cornerstone Academic Services may change the contents and software on the site, and the products and services described within or offered on the site at its sole discretion without notification to the user. Moreover, Cornerstone Academic Services is not responsible for technical, hardware, or software malfunctions of any kind.

As a Website User, you acknowledge that Cornerstone Academic Services is being retained in a consulting role and that the Company’s affiliates, employees, and partners are providing a service where the final outcome of the product is reliant upon your acceptance, rejection, or further amendment of the work submitted for review. As a result of this responsibility, the content of the final product is the sole responsibility of the person submitting it: Cornerstone Academic Services does not make any warranty or guaranty to the quality of any work on which it provides its services. The information contained in files edited or written by Cornerstone Academic Services may include opinions or views that are not those of the Cornerstone Academic Services or any person associated with the Cornerstone Academic Services. Additionally, Cornerstone Academic Services is not responsible or liable in relation to the use of any information contained in customer files including misleading or defamatory statements, or the infringement of third party copyright.

Remuneration and Conditions for Services Rendered; Cancellation Policies

Before Cornerstone Academic Services can begin providing services, compensation must be received from the User to Cornerstone Academic Services in the form of a PayPal payment, accepted credit and/or debit card, check, cash, money order, or other forms of certified funds. In the event that a payment is not made, for whatever reason, or is deemed late by Cornerstone Academic Services, you agree by submitting content, that Cornerstone Academic Services reserves the right to assess a late charge commensurate with its administrative fees and expenses in seeking out the late payment by you, including legal attorney’s fees and court fees. A payment will be constituted as “late” if it is not received within forty-eight (48) hours upon commencement of providing services. In the event that a payment is dishonored by your financial institution for whatever reason, you agree that Cornerstone Academic Services has a right to automatically charge you a $35.00 fee or five percent (5%) of the transaction, whichever is greater, without prior written approval from you.

Furthermore, by using our payment processing system online, you acknowledge that Cornerstone Academic Services is not responsible for the actions of any third-party company-affiliated software used by Cornerstone Academic Services to process online payments. Additionally, you indemnify Cornerstone Academic Services for the fraudulent use of any credit card or other payment method that may be used to purchase its services.

For items that are based on a time frame, standard or expedited, you agree that the time frame and work will begin after the file, payment, and necessary information to complete the service is received by the company, whichever comes last. Orders can only be cancelled up to one (1) hour after commencement. Cornerstone Academic Services may charge twenty-five ($25) dollars for its administrative expenses to cancel your order.

If any credit is applied to the student’s account with Cornerstone Academic, the credit may not be used in conjunction with any ongoing promotions or discounts offered. The credit may only apply to services offered by Cornerstone Academic.

Since Cornerstone Academic Services is in an industry where quality is subjective, refunds will not be offered under any circumstances and any conditions. Cornerstone Academic Services does not make any warranties, expressed or implied, to the quality of its work.

Course Cancellation Policy

If you choose to withdraw your enrollment in a classroom course fourteen (14) or more days before the first scheduled session of your program, we will refund the fees you have submitted minus any transaction fees we incur in processing the payment. The transaction fees can vary based on the total transaction amount and can be up to thirty dollars ($30).

If you decide to withdraw your enrollment in a classroom course less than fourteen (14) days and more than three (3) days before the first scheduled session of your program, we will refund all of the tuition you have paid less a processing charge of $199.00.

No cancellations or refunds will be processed less than three (3) days before the course is scheduled to begin under any circumstances.

No transfers to different programs will be permitted less than one (1) days before the course is scheduled to begin under any circumstances.

Course Timings: Cornerstone Academic Services reserves the right to change the start and/or end time of a course for any reason so long as it provides at least 2 hours of notice to students enrolled in that course. If a student cannot accommodate the change in course timings, the student may make up the work at home or request to retake that course session at a later date.

Individual (1-on-1) Tutoring Session Cancellation Policy

If you choose to cancel or modify an appointment for individual tutoring, private tutoring, or one-on-one (1-on-1) tutoring, forty-eight (48) or more hours before the scheduled appointment, we will credit all of the fees you have paid for that session or for the adjusted timing(s) toward a future session. If you choose to modify or cancel your appointment less than forty-eight (48) hours before the scheduled appointment, you will forfeit that session or the adjusted timing(s). Note: All purchased Individual Tutoring Package hours are non-refundable.

For the Individual Tutoring Program, all payments are final and deemed non-refundable under any circumstances whatsoever. The User acknowledges that Cornerstone Academic Services will deduct the instructional fee as described to them via email.

If you cancel more than two (2) sessions in a twelve (12) week period, future sessions for your student will be removed from the calendar and you will only be able to schedule one session at a time.

Books and Materials Policy

If any books, materials, and/or additional items, including, but not limited to, textbooks, course workbooks, course worksheets, course handouts, writing utensils, and other items are assigned to the student as part of the Summer Booster Program, Final Exam Review Sessions, AP Exam Review Sessions, and other programs offered by Cornerstone Academic, then said materials must be returned to Cornerstone Academic within five (5) business days of cancellation of enrollment from the Unlimited Tutoring Program. Failure to return the aforementioned items in a timely manner will result in an additional fee of one hundred and fifty dollars ($150.00).

Student Disruption Policy

Disruptive academic behavior is any behavior likely to substantially or repeatedly interfere with the normal conduct of instructional activities.  Examples of such behavior include, but are not limited to, making loud or distracting noises; using cell phones and other electronic devices without prior approval; repeatedly speaking without being recognized; frequently arriving late or leaving early from class, and making threats or personal insults.

If any student exhibits disruptive behavior or interferes with the instruction of the class or program the student is enrolled in, then, at the sole discretion of the instructor, the offending student will be removed from the class or program and no refund will be offered. For SAT and ACT classes, the student may not return to the same course in which the disruptive behavior was exhibited. The student’s parent/guardian must speak with Cornerstone Academic staff regarding behavior before the student can participate in a future course. For the Unlimited Tutoring Program, the student must have his or her parent speak to the Center Director before he or she can resume attendance in the program.

Online Retake Guarantee Details

Students that complete any of our SAT or ACT preparation courses may repeat the type and kind of course they completed in the online format at no extra charge provided that any and all accounts with Cornerstone Academic are in good standing, including, but not limited to SAT Prep, ACT Prep, and Individual Tutoring. The Online Retake Guarantee does NOT extend to newer versions of the exam that the College Board or the ACT, Inc. may administer. For example, if a student participated in a preparation course for 2015-2023 version of the SAT, they are not eligible to participate in a preparation course for the Digital SAT under the Online Retake Guarantee.

Either the parent or the student must email achieve@cornerstoneacademic.com and inform Cornerstone Academic of their intent to retake the course online. Requests to retake the course online must be submitted at least two weeks (fourteen days) prior to the start date of the course. Students may not retake the course at the Suwanee Town Center location in Suwanee, GA unless space permits after all new students who wish to take the course at Suwanee Town Center have enrolled for a given course. Students will be added to a waitlist for their preferred course and informed via email if space is available. Please note that if a new or updated set of materials is needed, a fifty dollars ($50.00) materials fee applies.

Limitation of Liability

As a user of this website, you completely agree to hold Cornerstone Academic Services and its affiliates and partners harmless from any losses or damages, including: claims and actions of any kind as a byproduct of your usage of the site due to computational transmission error; service delays by Cornerstone Academic Services due to reasons beyond its control; injuries, losses, and damages of any kind as a result of using this website; and any print or typographical error in any materials associated with Cornerstone Academic Services.

Additionally, by using this website, you hereby agree that Cornerstone Academic Services will not, for any reason or situation, and regardless of the legal pronouncement of the law, be liable to you or any other party for any damages whether they be direct, indirect, accidental, incidental, consequential, punitive, or any other damages that may arise under any circumstance, and regardless of the character, including without limitation to lost profits, savings, or programs or any other data on your computational device or otherwise, even if Cornerstone Academic Services has been advised of the possibility of such damages.

This liability limitation aforementioned applies to any damages arising out of or in connection with your access to, utilization of, or inability to use, the site or any errors or omissions in the content of the site including the services offered through the site.

Indemnification

You agree to defend, indemnify, and hold Cornerstone Academic Services, its partners and affiliates, harmless from and against any and all claims, losses, damages, liabilities, costs and expenses, including, but not limited to, attorneys’ fees, arising from or related to your use of the Website or breach of any of these Terms. The unauthorized usage of services rendered by Cornerstone Academic Services, including but not limited to, the content of this Website may result in maximum civil or criminal penalties as allowed by law.

The Website and all information, documentation, and other content (“Content”) posted in or on the Website are copyright 2007-2011 Cornerstone Academic Services and its affiliates. Solutions

In the event that Cornerstone Academic Services determines, in its sole discretion, that you have breached any of the Terms, or have otherwise engaged in inappropriate conduct, Cornerstone Academic Services may, in addition to any other remedies that may be available, warn you of the violation via e-mail; delete any content provided by you or your agent(s); terminate your use of the Website; notify and fully cooperate with the proper law enforcement authorities for further action; or take any other action which Cornerstone Academic Services deems to be appropriate.

Governing Law of this Website

Information on the Website includes descriptions of products and services available only in the United States of America. These Terms are governed by and interpreted pursuant to the laws of the State of Georgia, United States of America, notwithstanding any conflicts of laws principles, and venue shall rest exclusively in the courts situated in the State of Georgia, Gwinnett County. If any part of these Terms is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining Terms.

Complete Agreement

The aforementioned Terms comprise the complete and exclusive document of the understanding of the parties and takes precedent and cancels all previous written and/or oral agreements and communications relating to the subject matter hereof.
